Shelter’s S21 example case, on the facts given, would be a retaliatory eviction and the courts would have probably rejected the possession claim had the case been taken to court.
There is no excuse for a landlord not keeping a heating system in safe working condition, but it seems that the tenant (and Shelter) did not take this to court or involve environmental health.
