The Health and Safety Executive (HSE) have changed the legislation for Gas Safety Checks.
Gas checks for rental property (CP12’s) will now be allowed to be done 2 months ahead of time whilst retaining the existing renewal date, like the rules of a car MOT.
This will come into force in two days’ time on April 6th and will mean that landlords will find it much easier to schedule these annual checks without losing time off their certificate.
Don’t forget that it is a criminal offence not to have a valid CP12, and following a recent ruling we strongly advice the CP12 is given to a new tenant before they occupy.
If you are unable to gain entry to the property you don’t have the right to force entry/enter without the tenants’ permission:-
try to make three separate valid attempts to enter;
leave a note each time to say entry was not possible;
after the last occasion write to the tenant telling them of the problems, informing them they are now responsible for the lack of CP12; inform the HSE of the history of these attempts.
